Three developments stand out this week. First, the Consumer Legislation Amendment Act 2026, Act 36/2026, received Royal Assent on 8 September 2026, and under section 2(1) the provisions inserting new section 405A of the Residential Tenancies Act 1997 commenced the following day, so from 9 September 2026 a renter may elect in writing to pay the bond directly to the Residential Tenancies Bond Authority. Second, NDIS Commission enforcement took effect inside the window in Victoria, with revocations of registration operative from 5pm 7 September 2026 at Cranbourne East and Fraser Rise and from 5pm 8 September 2026 at Melton, while a further six Victorian provider exits carry effect dates from 14 September 2026 onward. Third, the Melbourne market split further by measure, with Cotality reporting upper quartile house values 10.5 per cent below peak while advertised asking rents rose again to $696.00 per week combined in the week ending 12 September 2026. On the ground this week
Four Melbourne clearance rate constructions are in circulation this week and none should be blended. Domain reported a preliminary Melbourne rate of 62 per cent for the weekend of 6 to 12 September 2026, from 536 of 768 scheduled auctions reported, 334 sold, 134 passed in and 68 withdrawn, with total sales of $235,816,100 and a median reported auction sale price of $970,000, against 69 per cent this time last year. REIV, on a reported basis for Victoria, had not published that weekend at this cutoff and still showed the week ending 6 September 2026 at 71 per cent from 427 reported, revised upward from 356 reported at 73 per cent a week earlier, with houses at 70 per cent and a median of $1.1 million and units at 78 per cent and a median of $845,000. Nationally, secondary reporting of CoreLogic gave 60.6 per cent for the weekend ending 6 September, the highest since May, on 1,815 auctions held, down 33.0 per cent year on year, while Cotality's four week average sat at 49.5 per cent and has stayed below 50 per cent since early June. The steadier read across all series is thinner volume than a year ago.789125
Melbourne value declines are now concentrated at the top of the market. Cotality's September 2026 Monthly Housing Chart Pack, indexed to August 2026, records Melbourne upper quartile house values 10.5 per cent below peak against a 6.6 percentage point gap to lower quartile houses, and a 4.9 percentage point gap for units, with Sydney upper quartile houses 10.7 per cent below peak. Nationally, dwelling values are down 3.1 per cent over the three months to August 2026, median time on market has stretched to 39 days from 28 a year earlier, median vendor discounting sits at 4.2 per cent, the highest since January 2023, and total listings exceed 139,100, up 18.1 per cent year on year.5
Rents and vacancy moved in the opposite direction to values, and the two are read as separate series. Melbourne combined advertised asking rents were $696.00 per week in the week ending 12 September 2026, up $1.11 on the week and 6.1 per cent over 12 months, with houses at $826.79, up 7.7 per cent, and units at $600.86, up 4.3 per cent, and two bedroom units at $617.22, with SQM's next update stated as 20 September 2026. Vacancy is a separate monthly reading of 1.78 per cent for August 2026 from 9,534 listings against an estimated 535,317 rental dwellings, marginally looser than 1.75 per cent in July. We publish no Melbourne gross rental yield, because none was verified from a fetched page.610
Rents are now a monetary policy talking point rather than just a housing statistic. Secondary reporting of ABS data put Consumer Price Index property rental growth at 3.6 per cent in the year to July 2026, down from a 7.8 per cent peak, while Cotality advertised rents across the combined capitals were tracking at 5.7 per cent in the year to August 2026, and the Reserve Bank Assistant Governor said at the AFR Property Summit that the Bank is paying very close attention to rents. Separately, Cotality's daily index sat 5 per cent below its April 2026 peak, and the Westpac Melbourne Institute survey released 8 September 2026 showed dwelling price expectations down around 36 per cent over six months.1314
From the regulatory front
No ATO ruling relevant to residential property carries a date inside the window. Three items on the legal database's What's new page fall inside the window, a legislative instrument of 11 September 2026 on a tax invoice waiver, a class ruling of 9 September 2026 on an in specie share distribution, and an erratum to an older GST ruling on dental services, none of them property related. The property relevant baseline remains the rental income and deductions ruling package and the apportionment and holiday home practical compliance guidelines, all published 20 May 2026.1516
This is the material development of the week for Victorian operators. The Consumer Legislation Amendment Act 2026, Act 36/2026, received Royal Assent on 8 September 2026, and section 2(1) brought a specified set of provisions, including Divisions 5, 7 and 9 of Part 7, into operation the following day, 9 September 2026. Division 5 inserts new section 405A of the Residential Tenancies Act 1997, letting a renter elect in writing to pay the bond directly to the Residential Tenancies Bond Authority, with the rental provider then required to complete and sign the approved bond lodgment form, give it to the renter to sign, lodge it with the Authority and give the renter a copy, on penalty of 25 penalty units for an individual and 125 for a body corporate. New section 405A(5) requires the Authority to request payment from the renter, who must pay within 2 days under section 77. The penalty attaches to the provider, not the renter.12
A rooming house specific provision in the same Act is legislated but not yet in force. New section 94FA prohibits a rooming house operator from refusing occupancy of a room because a person has been or is being subjected to family violence or personal violence, and from instructing or permitting an agent to do so, with defined exemptions for specified public and registered entities. Division 1 of Part 7, which contains section 94FA, is not listed in section 2(1), so it commences on a day to be proclaimed, with a 1 June 2027 backstop under section 2(5). The related offence provision, new section 405B, is likewise awaiting proclamation. Separately, under section 2(2), Division 2 of Part 5 other than section 23 commences 1 October 2026, bringing reserve price disclosure at least 7 days before an auction or fixed date sale and the property price statement regime, a sale process reform relevant to anyone acquiring or disposing of multi-tenant stock at auction this quarter.143
Consumer Affairs Victoria itself published nothing renting related inside the window, and the rental law changes page had not been updated to reflect the new Act at this cutoff. The compliance calendar there is unchanged baseline: from 13 October 2026, strengthened bond claims requiring advance notice and supporting evidence, records showing minimum standards compliance, mandatory gas and electrical safety checks every 2 years regardless of when the agreement commenced, a gas check within 6 months before draughtproofing, and a ban on application fees, with minimum energy efficiency standards phased in from 1 March 2027.1920
Nothing operative landed on the NDIS scheme side inside the window. The consultation on proposed access changes, covering functional capacity assessment and the evidence base for access decisions, remains open from 31 August 2026 to 2 October 2026, and no dated in-window ministerial item or legislation hub update was found. SDA pricing could not be verified this week, because the SDA pricing and payments page was refused to automated fetching under robots rules, so no price limit or 2026-27 pricing document is published.212223
No material verified update came from the Victorian State Revenue Office or Housing Australia inside the window. The SRO's most recent news item remains an Auscontact recognition of 25 August 2026 with no tax content, and its public rulings register still shows its two most recent rulings both issued 20 July 2026. The rooming house land tax exemption page could not be read this session due to a fetch error, so the exemption tests are not restated as verified this week. Housing Australia's news and media page returned a client error and its media centre was refused to automated fetching, so no figure or date is published on build to rent incentives, the National Rental Affordability Scheme wind down or investor relevant private rental policy.2526272829

Backstop commencement for the rooming house occupancy refusal prohibition, section 94FA, if not proclaimed sooner
The operating law change this week is administrative and it started on 9 September 2026. New section 405A lets a renter elect in writing to pay the bond amount directly to the Residential Tenancies Bond Authority, with the form, lodgment and copy obligations, and the 25 and 125 penalty unit exposures, falling on the provider. Operators who currently collect and lodge bonds themselves now need a process that can receive and act on a renter election, and bond lodgement has been a live Consumer Affairs Victoria enforcement theme, illustrated by a June 2026 matter in which an operator was taken to court over allegedly operating two rooming houses without a licence, referred by a council.1232
A screening prohibition specific to this build type is now on the statute book, though not yet operative. New section 94FA prevents a rooming house operator refusing occupancy of a room because a person has been or is being subjected to family violence or personal violence. It sits in Division 1 of Part 7, which is not listed in section 2(1), so it commences on a day to be proclaimed with a 1 June 2027 backstop, and the related offence provision, new section 405B, likewise awaits proclamation.143
Four Melbourne rent constructions are in circulation and none is comparable to the others. SQM reports advertised asking rents of $696.00 combined, $826.79 for houses and $600.86 for units for the week ending 12 September 2026. REIV reports an achieved metropolitan median weekly house rent of $600 for July 2026, with regional Victoria at $530, and had published no August value at this cutoff. The Homes Victoria Rental Report still presents the September quarter 2025 as current, at a metropolitan median of $580 per week. Nationally, Consumer Price Index rents sit at 3.6 per cent in the year to July 2026 against advertised rents at 5.7 per cent in the year to August 2026. Vacancy splits the same way, with SQM at 1.78 per cent for August 2026 on a listings method against REIV at 2.6 per cent for July 2026 on a lease method, and neither measures room level vacancy.6373813
The room level evidence gap is now structural rather than a temporary access issue. The commercial share accommodation price index used in earlier editions returned a 404 response at its previous address this session, so no current Melbourne room rent, data date or change figure can be published. The most recent shared accommodation research on the industry listing remains a national survey dated 5 December 2025. The one Victorian dataset isolating rooms in shared accommodation as an affordability category remains the Anglicare Victoria snapshot from a March 2026 weekend, now about six months old, which reports no real progress for low income renters and a slight improvement for minimum wage earners attributed to wage increases rather than supply.404142
No statewide premises or operator count is published, because the operator register records licensee names, ABN or ACN, and grant and expiry dates only, and expressly does not record premises, which sit in council registers. The Urban Development Program landing address used in prior editions now returns a page not found response and the live 2025 program pages were refused to automated fetching, so no land supply figure is published. On renter side capacity, Tenants Victoria has been confirmed for two of four statewide services under the Victorian Renter Rights Program, expected to help more than 25,000 renters annually across 17 local services from early 2027, so the compliance calendar for Victorian multi-tenant assets now has two live edges, the 13 October 2026 tranche and this expanding advocacy capacity, rather than one.303133343620

NDIS access consultation closes, covering how functional capacity is assessed
This is the first week in several where Victorian enforcement was operative rather than pending. Revocation of registration took effect from 5pm 7 September 2026 for Aask Care Pty Ltd of Cranbourne East VIC 3977 and for Atiki Pty Ltd of Fraser Rise VIC 3336, both on the basis that a delegate formed a reasonable belief of contravention of section 73F(2)(c) of the National Disability Insurance Scheme Act 2013 for not complying with NDIS Practice Standards, having regard to audit outcomes. Both listed registration group 115, group or shared living, and group 138, supported independent living, and Atiki also listed group 101, accommodation and tenancy assistance. A third Victorian revocation, of The Trustee for Lifeful Discretionary Trust of Melton VIC 3337, flagged as scheduled in our prior edition, took effect from 5pm 8 September 2026, on a notice alleging failure to commence a mid term audit within 18 months of registration.3
The practical exposure for an SDA or shared living asset owner is tenancy continuity rather than the dwelling itself. Each of these three entries states the provider can no longer provide specialist disability accommodation, supported independent living, platform services or plan management. Two sit in Melbourne growth corridor locations and carried shared living and household task registrations, so where a support provider rather than the property loses registration, it is the occupancy arrangement that is interrupted.3
The first in-window action carrying registration group 131, specialist disability accommodation only, is not Victorian. Holistic Quality Care Pty Ltd of Ramsgate NSW 2217 had its registration revoked from 5pm 7 September 2026 on the same Practice Standards ground, with listed groups including 101, 115, 131 and 138. This shows SDA registration itself sits inside the enforcement perimeter, not only the support services wrapped around it. A second entity listing group 131, Inconsequential Asset Management Pty Ltd of Sydney NSW 2000, is scheduled rather than effective, from 5pm 28 October 2026. None of the three Victorian revocations that took effect in-window lists group 131.34
A large tranche of new actions was issued inside the window with effect dates after this cutoff, and six are Victorian. Notices dated 8 and 10 September 2026 set twenty listed actions effective from 5pm 14 September 2026 onward. The Victorian entries are James Michael Grace of Eltham VIC 3095, Pacific Breed Care Provider Pty Ltd of Wyndham Vale VIC 3024 and Unlimited Positive Hopes Pty Ltd of Springvale VIC 3171, all effective 5pm 14 September, R.A Russ and T.D Russ of California Gully VIC 3556 from 5pm 15 September, Disability Services Metro Pty Ltd of Knoxfield VIC 3180 from 5pm 28 September, and The Trustee for AJS Family Trust of Brunswick VIC 3056 from 5pm 7 October. All are scheduled rather than effective at this cutoff. A banning order against an individual at Strathtulloh VIC 3338, made 31 August 2026, took effect from 5pm 8 September 2026 and runs for two years, operating nationally regardless of the provider's listed address.34
No new data or pricing landed on the SDA side. The current supplement remains the 2025-26 Q4 edition, so it is baseline data as at 30 June 2026 rather than an in-window release, and Supplements D, E and P continue on a quarterly cycle while several others moved to six monthly, meaning the next quarterly Supplement P, covering the quarter ending 30 September 2026, is the trigger to watch. No SDA price limit is published, because the pricing page was refused to automated fetching this session, and no demand tool figure or platform listing count is published, because those pages either could not be reached or did not render numerical data.44234546
What we're watching
From 14 September 2026: six Victorian provider exits take effect in stages. Twenty NDIS Commission actions issued inside the window carry effect dates after this cutoff, six of them Victorian, running from Eltham, Wyndham Vale and Springvale on 14 September through to Brunswick on 7 October. A second provider listing registration group 131 is scheduled from 28 October 2026 in Sydney. We are watching whether these convert on their stated dates, as last week's Melton revocation did, and where affected participants' support arrangements transfer.34
20 September 2026 onward: the next rent, vacancy and auction prints. SQM's next weekly rents update is stated as 20 September 2026, from a combined asking rent of $696.00 and 6.1 per cent annual growth this week. We are also watching the next monthly vacancy observation after August 2026's 1.78 per cent, and whether REIV catches up to the 12 September auction weekend and how far its reported basis lands from Domain's 62 per cent preliminary rate. REIV's own preview expected about 770 auctions for the week ending 13 September 2026.6109749
1 October 2026: auction and price disclosure reforms commence. Reserve price disclosure at least 7 days before an auction or fixed date sale, and the property price statement regime, take effect under the Consumer Legislation Amendment Act 2026. This is a sale process observation rather than a tenancy one, relevant to anyone acquiring or disposing of multi-tenant stock at auction this quarter. We are watching for practitioner guidance before the date.143
2 and 13 October 2026: a consultation closes and a rental tranche lands. Consultation on proposed NDIS access changes closes 2 October 2026, upstream of the SDA eligible cohort. Eleven days later, the Victorian rental tranche takes effect: strengthened bond claims, minimum standards records, gas and electrical safety checks every 2 years, a gas check within 6 months before draughtproofing, and a ban on application fees. We are watching whether the Director of Consumer Affairs Victoria publishes the records guidance that page contemplates.2120
Proclamation watch: the rooming house occupancy provision and section 405B. New section 94FA, the only provision in the new Act written specifically for this build type, and the related offence provision, new section 405B, both await proclamation with a 1 June 2027 backstop. We are watching the Victorian Government Gazette for a proclamation date, alongside further statutory backstops falling on 1 December 2026, 1 July 2027 and 1 December 2027.143
